Irelandhotels.com New System Terms and Conditions

Irelandhotels.com and its associated websites (together the “Websites”) are operated by the Irish Hotels Federation (together with its affiliates, agents and suppliers and, where relevant, the Websites, the “IHF”).and are hosted and managed by Promotion Payment Solutions (the “Service Provider”). These Terms and Conditions apply to any hotel or guesthouse (hereafter “You”) offering accommodation and related services via the Websites (the “Accommodation”).

 

You agree that:

Bookings will be made directly with hotels and guesthouses by guests

Gift Cards should be requested at check-in from guests by hotels and gift card balance checked, the IHF will take no responsibility of a hotels failure to obtain gift card details from guests

You accept responsibility for ensuring the accuracy of all information provided to the Websites in relation to the Accommodation and you will update such information when appropriate.  You will be liable in full if IHF suffers any loss due to your provision of inaccurate, false or incomplete information or for the supply of an image or text in breach of a third party's intellectual property rights (including copyright).

Please note that “old model” gift codes will also be recognised on the new Irelandhotels system, and must be accepted by hotels.

The IHF shall not be liable to you, whether in contract or tort or otherwise, for any loss or damage whether direct, indirect or consequential loss or damage (including loss of profit, revenue or data) arising out of, or in connection with the Websites or these Terms and Conditions. In particular, the IHF shall have no liability for unavailability of the Websites or any technical difficulties encountered by you or by guests in using or accessing the Websites.

If you Opt In to avail of the new “Direct Booking” gift card, you will accept the gift card as a form of payment in your hotel.

Failure to accept the gift card may result in your suspension from the Websites. You shall reimburse the IHF and/or its Service Provider and/or its partner(s) for any costs incurred due to your failure to honour Bookings.

You will make every effort to settle a complaint made by a guest in respect of the Accommodation. The IHF is not liable for any costs arising from these complaints.

You shall be solely liable to guest(s) for any loss that he/she may suffer in connection with the Accommodation.  You shall indemnify the IHF in respect of any and all claims, liabilities or losses (including consequential or indirect loss or damage and also including Irelandhotels.com associated professional fees) arising from any breach of these Terms and Conditions by you or any claim brought by any guest arising from or in connection with the Booking including the guest's use of the Accommodation, or any action of your employees, agents or subcontractors.

You will pay the IHF the relevant commission rate set out in the Schedule to these Terms and Conditions. Where a Booking is made using an Irelandhotels.com Gift Card, the IHF or its Service Provider will forward you any amount due to you by the guest spending the Gift Card on Accommodation in your hotel.

For the purposes of VAT, the IHF will be acting as an intermediary between you and the guest and, for the avoidance of doubt, the IHF will not be acting as a principal or as an undisclosed agent or on behalf of the guest. The IHF agrees to act on your behalf and our fee for our intermediary services is payable by you. The guest pays no fee to the IHF. You confirm that you are established in Ireland for Irish VAT purposes. Our fee is subject to the standard rate of Irish VAT which is currently 23% but which may be amended by statute from time to time.

The IHF or the Service Provider will issue you with a VAT invoice on a monthly basis reflecting our fees for all Bookings processed by the Websites on your behalf in the previous month. 

It is the responsibility of the hotel to make any necessary changes to admin users , email address or bank detailsThese Terms and Conditions supersede all prior agreements. 

These Terms and Conditions are assignable in whole or in part by the IHF but are not assignable by you.

These Terms and Conditions are governed by the laws of Ireland and are subject to the exclusive jurisdiction of the Irish Courts.

Any changes or updates to these Terms and Conditions will be notified to you by email 14 days in advance of such amendments taking effect.

By logging into the PCT Redemption terminal you are automatically acceptings these Terms and Conditions.

Should you wish to withdraw from this Agreement prior to such amendments taking effect, you must notify IHF in writing within that notice period. At all other times, you must give IHF at least 14 days’ notice in writing of your intention to withdraw from this Agreement.

Payment are made at the end of each calendar month, PPS will issue a report to the IHF with all the transactions for the month for each Hotel.  The amount will be net of the commission which is 10%.  IHF will pay this amount to the Hotel by EFT in 5 working days. These terms will replace all previous payment terms in place once new booking system is available to the general public.

You will pay Irelandhotels.com the following commission rates on the total value of each Booking, plus VAT 

IHF Members: 10%;
